Acceptance of Terms
By accessing or using the Moqa website at moqa.ae, our mobile application, or any related services (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not access or use the Platform.
We reserve the right to update or modify these Terms at any time. Changes will take effect when posted on the Platform with an updated “Last Updated” date. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
About Moqa
Moqa is a curated discovery platform that helps users explore restaurants, bars and cafes in Dubai. The Platform aggregates publicly available information about venues and presents it alongside curated recommendations from chefs, food personalities and editorial voices. Certain venues may also participate as Moqa partners, in which case additional content, featured placement, or exclusive offers may be made available through the Platform.
Moqa is an independent platform. Unless explicitly identified as a partner venue, no affiliation, endorsement, sponsorship, or agency relationship exists between Moqa and any venue, restaurant, bar, cafe, chef, or other third party featured on the Platform.
Nature of the Service
The Platform is provided as an informational discovery tool only. Moqa does not operate, manage, or control any venue listed on the Platform. We do not provide food and beverage services, hospitality services, reservation guarantees, or any other services offered by the venues themselves.
From time to time, the Platform may display promotions, offers, discounts, events, or activations made available by venues, whether through a partnership arrangement with Moqa or otherwise. These are provided by the venues themselves and are subject to the venue’s own terms, conditions, availability, and discretion. Moqa acts solely as a channel for displaying such offers and is not a party to any transaction or redemption arising from them.
Any transaction, booking, visit, dining experience, redemption of an offer, or other interaction between you and a venue is solely between you and that venue. Moqa is not a party to any such transaction or interaction and assumes no responsibility or liability in connection with it.
Publicly Available Content and Third-Party Information
4.1 Source of Venue Information
All venue information displayed on the Platform, including but not limited to venue names, descriptions, photographs, logos, menu details, pricing, opening hours, location data, contact information, and social media references, is sourced from publicly available channels unless provided directly by a partner venue. Public channels include, but are not limited to, the venues’ own websites, public social media profiles and posts, publicly accessible review platforms, public directories, and other openly available online sources.
Moqa does not claim ownership of any venue’s name, brand, logo, imagery, or intellectual property. All such materials remain the property of their respective owners. The display of venue information on the Platform is for informational and discovery purposes only and does not imply any association, endorsement, sponsorship, or commercial relationship between Moqa and the venue unless explicitly stated.
4.2 No Guarantee of Accuracy
While we make reasonable efforts to present accurate and up-to-date information, Moqa does not warrant, represent, or guarantee the accuracy, completeness, reliability, timeliness, or currentness of any venue information displayed on the Platform. Venue details such as menus, pricing, opening hours, availability, offers, promotions, discounts, events, and activations are subject to change at any time by the venues themselves without notice to Moqa.
You acknowledge and agree that you rely on any information presented on the Platform entirely at your own risk. We strongly encourage you to verify all venue details, including any offers or promotions, directly with the venue before visiting, making a reservation, or taking any action based on information found on the Platform.
4.3 No Endorsement of Venues
The inclusion of any venue on the Platform does not constitute a recommendation, endorsement, or guarantee of quality by Moqa. Curated recommendations presented on the Platform reflect the personal opinions of the recommending chefs, food personalities, or editorial voices and do not represent the views, assessments, or guarantees of Moqa.
Moqa accepts no liability for the quality of food, beverages, service, hygiene, safety, or any other aspect of your experience at any venue discovered through the Platform.
4.4 Venue Content and Removal Requests
If you are a venue owner, operator, or authorised representative and you wish to request the removal or amendment of any information or imagery relating to your venue on the Platform, please contact us at partnerships@moqa.ae. We will review your request and take reasonable steps to address it in a timely manner.
Moqa reserves the right to determine, at its sole discretion, what content is displayed on the Platform. However, we respect the intellectual property rights of venue owners and will act in good faith to resolve any legitimate concerns.
Featured Content, Partnerships and Offers
Moqa may enter into partnership arrangements with selected venues. Partner venues may receive featured placement, enhanced listings, or other forms of visibility on the Platform. Where a venue is a Moqa partner, this may be indicated on the Platform but is not required to be.
The Platform may also display exclusive offers, discounts, promotions, or other benefits made available by partner venues or other participating venues. All such offers are provided and fulfilled entirely by the relevant venue. The terms, conditions, validity, availability, and redemption of any offer are determined solely by the venue and may be changed or withdrawn by the venue at any time without notice to Moqa or to you.
Moqa does not guarantee the availability, validity, or honour of any offer displayed on the Platform. If a venue declines to honour an offer, or if any dispute arises in connection with an offer, that matter is between you and the venue. Moqa shall have no liability in respect of any offer, discount, promotion, or benefit, whether or not the venue is a Moqa partner.

User Accounts
Certain features of the Platform may require you to create an account. When creating an account, you agree to provide accurate, current and complete information, and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate your account at any time if we reasonably believe that you have violated these Terms, engaged in fraudulent or abusive behaviour, or otherwise acted in a manner that could harm Moqa, its users, or any third party.
Acceptable Use
When using the Platform, you agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorised access to any part of the Platform, its servers, or any connected systems.
- Scrape, crawl, harvest, or otherwise extract data from the Platform through automated means without our prior written consent.
- Reproduce, duplicate, copy, distribute, or exploit any part of the Platform for commercial purposes without our prior written consent.
- Upload, transmit, or distribute any content that is defamatory, obscene, abusive, infringing, or otherwise objectionable.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Interfere with or disrupt the Platform’s operation, security, or performance.
- Use the Platform to send unsolicited communications, advertising, or spam.
Intellectual Property
8.1 Moqa’s Intellectual Property
The Platform, including its design, layout, user interface, software, code, text, graphics, compilation, and all other original content created by Moqa, is the intellectual property of Moqa and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, or otherwise exploit any part of the Platform without our prior written consent.
8.2 Third-Party Content
Certain content displayed on the Platform, including venue photographs, logos, brand names, and other materials, is the intellectual property of the respective venue owners or third parties. Such content is displayed solely for informational purposes and remains the property of its respective owners. Moqa does not claim ownership of any third-party intellectual property.
If you believe that any content on the Platform infringes your intellectual property rights, please contact us at partnerships@moqa.ae with details of the alleged infringement. We will review and respond to valid notices in accordance with applicable law.
Recommendations and Editorial Content
The Platform features curated recommendations from chefs, food personalities, community figures, and editorial voices (“Recommenders”). These recommendations represent the personal opinions and preferences of the individual Recommenders at the time they were provided.
Moqa does not guarantee the accuracy, reliability, or suitability of any recommendation. Recommendations are not endorsements by Moqa and should not be treated as professional advice. Tastes, preferences, venue quality, and circumstances may change. You should exercise your own judgment when relying on any recommendation.
Moqa is not liable for any loss, disappointment, or negative experience arising from your reliance on any recommendation displayed on the Platform.
Limitation of Liability
10.1 Platform Provided “As Is”
The Platform and all content, information, offers, and services provided through it are made available on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Moqa disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
10.2 No Liability for Venue-Related Matters
Moqa shall not be held liable for any loss, damage, injury, illness, cost, expense, claim, or liability of any kind arising from or in connection with:
- The accuracy, completeness, or reliability of any venue information displayed on the Platform, including but not limited to menus, pricing, opening hours, availability, allergen information, dietary information, hygiene standards, or safety conditions.
- Any offer, discount, promotion, or benefit displayed on the Platform, including its availability, validity, terms, redemption, or a venue’s refusal to honour it.
- Any experience, transaction, interaction, or dispute between you and any venue, including but not limited to the quality of food, beverages, or service, health and safety incidents, billing disputes, reservation failures, or any other matter.
- Any act, omission, negligence, misconduct, or breach by any venue, its owners, operators, employees, or agents, whether or not the venue is a Moqa partner.
- Any reliance you place on information, imagery, recommendations, offers, or other content displayed on the Platform.
- Changes made by venues to their offerings, pricing, hours, availability, promotions, or any other details after such information was sourced and displayed on the Platform.
10.3 No Liability for Third-Party Content
Moqa does not control, verify, or endorse the content of any third-party website, application, or service linked to or referenced from the Platform. We accept no responsibility or liability for the content, accuracy, practices, or availability of any third-party resource.
10.4 Maximum Liability
To the maximum extent permitted by applicable law, Moqa’s total aggregate liability to you for any and all claims arising out of or relating to these Terms or your use of the Platform shall not exceed the amount you have paid to Moqa (if any) in the twelve (12) months preceding the event giving rise to the claim. If you have not made any payment to Moqa, our maximum aggregate liability shall be limited to AED 100.
10.5 Exclusion of Consequential Damages
In no event shall Moqa be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of business opportunity, or loss of goodwill, whether arising from contract, tort (including negligence), strict liability, or otherwise, even if Moqa has been advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold harmless Moqa, its founders, officers, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Platform or any content obtained through the Platform.
- Your violation of these Terms or any applicable law or regulation.
- Your violation of any rights of a third party, including any intellectual property, privacy, or contractual rights.
- Any dispute between you and any venue discovered through the Platform, including disputes relating to offers, promotions, or discounts.
- Any content you submit, post, or transmit through the Platform.
Third-Party Links and Services
The Platform may contain links to third-party websites, applications, or services, including venue websites, reservation platforms, delivery services, maps, and social media pages. These links are provided for your convenience only. Moqa does not control or endorse these third-party resources and is not responsible for their content, availability, privacy practices, or terms of use. Your use of any third-party resource is at your own risk and subject to that third party’s terms and policies.
Availability and Modifications
We aim to keep the Platform available and operational at all times, but we do not guarantee uninterrupted or error-free access. The Platform may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice and without liability to you. This includes the right to add, remove, or modify venue listings, partner content, offers, features, or functionality.
Termination
We may restrict, suspend, or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination shall continue to apply, including but not limited to Sections 8, 10, 11, 15, and 16.
Governing Law and Dispute Resolution
These Terms and any dispute arising out of or in connection with them or the Platform shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts in Dubai, United Arab Emirates.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Moqa regarding your use of the Platform. They supersede all prior agreements, communications, and understandings, whether written or oral, relating to the subject matter of these Terms.
